		<description>The new approach for determining bad faith damages will likely provide predictability and fairness in employment negotiations. These qualities are heavily valued in our common law system. Assuming that the average settlement award remains similar, I believe it will result in better outcomes for both employees and employers in future negotiations. The predicability and fairness encompassed in this new approach may also save money in negotiations by allowing a more efficient negotiation by dissuading the parties from squabbling over differences in their expectations of the severance award.</description>
