I agree that the pivotal &quot;question is whether war crimes ... are themselves acts that are &#039;manifestly inconsistent with public order as understood in international relations.&#039;&quot;  However I&#039;m not sure I would answer in the affirmative. 

Everyone knows that Israel occupies land outside its borders, but no state with the power to stop this cares.  If the occupation is indeed a war crime, this suggests that it&#039;s nonetheless not actually &quot;inconsistent with public order.&quot;  A cynic (aka &quot;realist&quot;) might even go so far as to say that war crimes, like the rest of public international law, are only taken seriously in international relations when a state can advance its own agenda by doing so.  If this is true, then perhaps Cullen J. got the answer to the pivotal question right.</description>
